DCMS Founding Partner Program
Terms & Conditions
Last updated: 2 November 2026
1. Program Overview
The Digital Cut Media Solutions (DCMS) Founding Partner Program is a limited, application-based, 30-day pilot designed to help selected Australian businesses evaluate a digital customer acquisition system.
The pilot may include Meta advertising, a business-branded landing page, CRM and automation setup through Kleevo, enquiry qualification and campaign reporting.
The Program is a trial intended to evaluate the effectiveness of these services in a real-world environment. It is not a guarantee of leads, customers, sales or revenue.
2. Eligibility and Acceptance
The Program is available only to businesses approved by DCMS.
Applicants may be assessed based on business history, industry, location, project values, operational capacity, reputation, sales processes and ability to respond to new customer opportunities.
DCMS reserves the right to decline applications based on reasonable commercial, operational or eligibility criteria.
Submitting an application does not guarantee acceptance. Successful applicants must enter into a separate Pilot Participation Agreement before services commence.
Unless otherwise approved by DCMS, participation is limited to one funded pilot per business or commonly controlled business group.
3. Pilot Costs and Duration
The approved pilot runs for 30 consecutive calendar days from the agreed advertising campaign commencement date.
During this period, DCMS covers the agreed setup, management and initial advertising costs, including an advertising allocation of up to AUD $1,000, unless otherwise specified in writing.
The Founding Partner is not charged for the agreed pilot services.
Any advertised Program value represents an estimate of the services and potential advertising investment provided. It is not a cash payment, guaranteed saving or financial return.
Additional services outside the agreed pilot scope are not included unless separately agreed.
4. Lead Generation and Qualification
DCMS will use reasonable care and skill to deliver the agreed marketing and lead qualification services.
A qualified opportunity is an enquiry assessed against criteria agreed for the participating business, which may include service requirements, geographic location, project type and timeframe.
A qualified opportunity does not guarantee that the prospective customer will request a quotation, book an appointment, proceed with work or generate revenue.
DCMS does not guarantee a minimum number of leads, qualified opportunities, appointments, sales or any particular financial return.
Prospective customers may change their minds, become unresponsive or choose competing providers. These circumstances do not automatically mean an opportunity was invalid.
DCMS will reasonably investigate genuine concerns about lead quality against the agreed qualification criteria.
5. Founding Partner Responsibilities
Participating businesses are responsible for:
Providing accurate business information and campaign materials.
Maintaining appropriate licences, insurance and service capacity.
Responding promptly to qualified opportunities.
Arranging appointments and site inspections.
Preparing quotations and closing sales.
Delivering services to customers.
Providing reasonable feedback on lead quality and outcomes.
DCMS is responsible for the agreed marketing and qualification services, not the participating business’s sales, quoting or fulfilment activities.
Failure to follow up opportunities may affect campaign performance and the ability to evaluate the pilot.
6. Fair Use and Prevention of Misuse
The Program is intended for businesses genuinely interested in evaluating a potential ongoing customer acquisition service.
Applicants and participants must provide truthful information and act in good faith.
DCMS may investigate suspected misuse, including fraudulent applications, materially false business information, fabricated enquiries, deliberately falsified campaign results or attempts to obtain multiple funded pilots through misleading business identities.
Where reasonably necessary, DCMS may suspend or terminate participation in response to material misconduct, subject to applicable law and any signed agreement.
Participants are not required to purchase ongoing services. Choosing not to continue after the pilot does not constitute misuse.
7. Pilot Status, Reviews and Reputation Protection
By participating, the business acknowledges that the Founding Partner Program is a limited 30-day trial, that advertising performance may vary and that commercial results are not guaranteed.
Both DCMS and participating businesses agree not to knowingly publish or communicate materially false or misleading factual statements about the other party, its personnel, products or services.
This includes knowingly fabricated allegations regarding advertising expenditure, lead qualification, campaign performance or service delivery.
Participants are encouraged to raise concerns directly with DCMS so that they can be investigated and, where appropriate, resolved.
Nothing in these Terms prevents a participant from publishing genuine and honest reviews, making lawful complaints, contacting regulators or exercising statutory rights.
Where a materially false factual statement is published, the affected party may request correction or removal and pursue remedies available under applicable law.
8. Ownership of Systems and Intellectual Property
Unless otherwise agreed in writing, DCMS and its relevant licensors retain ownership of their proprietary systems and infrastructure, including landing page templates, CRM configurations, automations, workflows and campaign frameworks.
Kleevo is the technology platform used to support the Program.
Participation does not automatically transfer ownership of the landing page, CRM infrastructure, automations or other proprietary assets.
Any subsequent purchase, licence or transfer of the system must be separately agreed in writing.
Participating businesses retain ownership of their own pre-existing branding, logos and other materials.
9. Customer Information and Privacy
Customer information collected through the Program will be handled in accordance with applicable privacy laws and relevant privacy notices.
DCMS, Kleevo and participating businesses must use customer information only for lawful, authorised purposes.
Qualification calls may be recorded where lawful and subject to applicable notification or consent requirements.
Access to, retention of and transfer of customer records following the pilot will be governed by applicable law and any signed agreement.
Ownership of technology infrastructure does not automatically confer unrestricted rights over personal information.
10. Completion of the Pilot
At the conclusion of the 30-day pilot, DCMS may review campaign performance and available lead outcomes with the participating business.
The business may be offered an ongoing paid service arrangement, with pricing, advertising costs and contract terms discussed separately.
There is no obligation to continue after the pilot, and no automatic conversion to a paid subscription.
If the business does not continue, access to DCMS-operated systems and services may cease, subject to agreed arrangements and applicable legal obligations.
11. Complaints and Liability
Concerns about campaign performance, lead quality or service delivery should be communicated to DCMS with relevant supporting information.
DCMS will make reasonable efforts to investigate genuine complaints.
Neither party is responsible for losses caused solely by the other party’s independent acts or omissions, subject to applicable law.
Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.
12. Changes and Governing Law
DCMS may update these Terms for future applicants. Material changes affecting accepted participants will be addressed in accordance with their signed agreements and applicable law.
These Terms are governed by the laws of Victoria, Australia.
