Free Website Terms & Conditions
These Terms & Conditions (“Terms”) govern the use of the FREE website development services provided by Digital Cut Media Solutions Pty Ltd ABN:16652757885 (“Company”) to its clients (“Clients”) in Victoria, Australia.
- Service Description: Company offers professionally designed one-page website development services to service-based businesses. The scope of work includes the creation of a mobile-responsive website with essential sections such as About, Services, and Contact. The website is optimized for search engines and hosted on Company servers.
- Client Responsibilities: Clients are required to provide all necessary information, content, and materials required for the development of the website in a timely manner. Clients are responsible for the payment of hosting and domain registration fees as specified by Company.
- Hosting Requirement: Clients must host their website with Company for a minimum period of 12 months from the date of website deployment. Early termination of hosting services may incur additional fees as specified by Company.
- Fees and Payment: No upfront fees are charged for the development of the one-page website. Clients are required to pay the hosting and domain registration fees as agreed upon. Any further upgrades or additions to the website, as well as third-party plugins, will incur additional charges as specified by Company.
- Ownership and Intellectual Property: Upon completion of the website, all rights, title, and interest in the website, including any copyrights or other intellectual property rights, shall belong to the Client.
- Limitation of Liability: Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the use of its website development services.
- Termination: Either party may terminate the website development agreement upon written notice if the other party fails to perform its obligations under the agreement.
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia.
- Modifications: Company reserves the right to modify these Terms at any time without prior notice. Clients are encouraged to review the Terms periodically for any changes.
- Entire Agreement: These Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior agreements and understandings, whether written or oral, relating to such subject matter.
By using Company’s website development services, Clients acknowledge that they have read, understood, and agreed to these Terms.
